Article 2 – Applicability
- These terms and conditions apply to every offer made by Noreline and to every distance contract concluded between Noreline and a consumer.
- Deviations from these terms are only valid if expressly agreed in writing.
- If any provision of these terms is wholly or partly void or voidable, the remaining provisions shall remain in full force.
Article 3 – The offer
- Noreline strives for the most accurate possible description of products, images, and specifications.
- Obvious mistakes, typographical errors, programming errors, technical errors, or evident pricing errors are not binding on Noreline.
- Images are for illustration purposes only. Minor differences in color, finish, packaging, or appearance may occur and do not in themselves constitute a defect.
Article 4 – Formation of the contract
- The contract is formed once Noreline has accepted the order.
- Noreline reserves the right to refuse or cancel an order in the event of:
- obvious errors in price or product information;
- incorrect or incomplete information;
- suspicion of fraud, abuse, or unauthorized use of payment methods;
- automated ordering behavior or unauthorized resale;
- technical malfunctions;
- circumstances that make performance of the contract reasonably impossible.
- If an order is cancelled after payment has been made, the amount already paid will be refunded.
Article 5 – Prices
- All stated prices include VAT, unless expressly stated otherwise.
- Any shipping costs are clearly displayed before the order is placed.
- Noreline is not bound by obvious pricing errors or other evident mistakes in the offer.
Article 6 – Payment
- Payment can be made using the payment methods offered on the website.
- Noreline is entitled to suspend the execution of an order until full payment has been received.
- In case of suspected fraud, abuse, or unauthorized use of payment methods, Noreline may carry out additional checks and suspend or cancel an order.
Article 7 – Delivery
- Noreline delivers to consumers in the Netherlands and other countries within the European Union.
- The expected delivery time is a maximum of 14 business days, unless expressly stated otherwise.
- If delivery proves permanently impossible, Noreline will inform the consumer and refund any amounts already paid.
- Exceeding the expected delivery time does not automatically entitle the consumer to compensation, without prejudice to the consumer's statutory rights.
Article 8 – Availability and shipping by suppliers
- Part of the assortment may be shipped directly by external suppliers.
- If a product unexpectedly proves unavailable, Noreline is entitled to terminate the contract and refund any amounts already paid.
- The use of external suppliers does not affect the consumer's statutory rights against Noreline.
Article 9 – Passing of risk
The risk of loss or damage to products passes to the consumer at the moment the consumer, or a third party designated by them, actually receives the products.
Article 10 – Conformity and statutory warranty
- Noreline warrants that the delivered products conform to the contract and meet the reasonable expectations the consumer may have of them.
- Consumers' statutory rights regarding conformity and statutory warranty remain fully applicable.
Article 11 – Statutory right of withdrawal
- The consumer has the right to withdraw from the contract within a cooling-off period of 14 days without giving reasons, insofar as the statutory right of withdrawal applies.
- Withdrawal can be exercised via the digital withdrawal function on Noreline's website.
- Upon receipt of the withdrawal request, the consumer will promptly receive an electronic confirmation of receipt.
- After withdrawal, the consumer has a further 14 days to return the goods.
Article 12 – Consequences of withdrawal
- The direct costs of returning the goods are borne by the consumer, unless expressly agreed otherwise.
- The consumer must handle the product and packaging with care and may only handle and inspect the product to the extent necessary to establish its nature, characteristics, and functioning.
- The consumer is liable only for any diminished value of the product resulting from use beyond what is necessary to assess the product.
- Noreline will refund all payments received from the consumer, including standard delivery costs, without delay and no later than 14 days after receipt of the withdrawal statement.
- Noreline may withhold the refund until the goods have been received, or until the consumer has demonstrated that the goods have been returned, whichever occurs first.
Article 13 – Exceptions to the right of withdrawal
The right of withdrawal does not apply to products for which a statutory exception applies, including:
- products manufactured according to the consumer's specifications or clearly intended for a specific person;
- sealed products that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery;
- digital content whose delivery has begun with the consumer's prior express consent and where the consumer has declared that they waive their right of withdrawal.
Article 14 – Complaints
- Complaints can be submitted via the contact form on the website or by emailing info@noreline.com.
- Noreline aims to respond to complaints within a reasonable period, in principle within 14 days.
Article 15 – Force majeure
- Noreline is not obliged to fulfill any obligation if performance is impossible due to force majeure.
- Force majeure includes, among other things:
- disruptions to telecommunications or payment systems;
- cyberattacks;
- failures of suppliers or carriers;
- government measures;
- strikes;
- epidemics;
- natural disasters;
- other circumstances beyond Noreline's reasonable control.
Article 16 – Abuse and fraud
Noreline reserves the right to suspend, refuse, or cancel orders, accounts, or transactions in the event of suspected fraud, abuse, unauthorized use of discount promotions, automated ordering behavior, or other actions that could harm the security or normal operation of the webshop.
Article 17 – Liability
- To the extent permitted by law, Noreline is not liable for indirect damage, consequential damage, loss of profit, missed savings, loss of data, or other purely financial loss.
- Nothing in these terms and conditions limits liability that cannot be excluded or limited under mandatory law.
- To the extent permitted by law, any liability of Noreline is limited to the amount the consumer paid for the relevant product.
Article 18 – Applicable law
- Dutch law applies to these terms and conditions and all contracts between Noreline and the consumer.
- If the consumer has their habitual residence in another EU member state, the mandatory consumer-protection provisions of that member state shall also remain applicable.
Article 19 – Digital products
Should Noreline offer digital products or digital content in the future, additional terms may apply to these.
